I have a concern about the states ability to jail citizens with a D.U.I. I have searched for the legal definition
of "under the influence" within the A.R.S. and found none.

Without the legal definition of a crime an individual has no ability to build a defense. That is illegal because
everyone has a right to defend themselves in a court of law.

All I can see is that the prosecution can prove that someones B.A.C. shows a certain amount of alcohol. This does not prove that ones ability to operate a motor vehicle has been impaired or altered in any way.

If it wasn't for the extreme jail sentences or the large fines I would not be so critical or so exacting but we are talking about peoples rights and freedom.I also do not want to be misunderstood in as far as I do not agree that we should allow people to drive drunk and I have never been stopped or charged with D.U.I..
